having been a bill collector I can tell you that even if you let them repossess it, you will most definitely have a deficient balance owing on the vehicle. I saw it a thousand times. People think that once the creditor repo%26#039;s the vehicle that, that%26#039;s the end of it. WRONG! the vehicle in question would go to auction, it needs major work.. I suspect the auction price wouldn%26#039;t exceed $1,000. leaving the balance of $9,000 still owing %26lt;YOU WOULD OWE THAT AMOUNT or whatever is left remaining and the creditor will send the balance to collections ruining your credit, or at the very least dinging it badly. The dealership is LYING to you!! GOOD LUCK!

Take it to a dealer, trade it in if you can and get whatever you can out of it and roll it into a lease, your payment might be higher but your negative equity will be over at the end of the lease. Also if you do get it repo%26#039;d they will sue you and if you do not pay for the remaining balance on the car they can garnish your wages, meaning they take a certain amount out of every one of your paychecks to pay off the car you got repo%26#039;d.

The difference twixt HP %26amp; CC is simple;



HP = If you do not maintain correct %26amp; proper payment the goods may be repossessed, or goods to the same value, but the vendor must first gain a possession order / distress warrant from the relevant court.



This can only be served by a bailliff under police escort, only the police can serve a copy of the relevant document, BEFORE the bailliff can gain entry / possesssion.



CC = The vendor does not have the same level of protection, %26amp; would most likely need to %26quot;file a suite%26quot; for civil damages, as possession is 9/10 of the law.



In conclusion, seek FREE legal advice, poste haste, on the validity of the contract which you believe is %26quot;null %26amp; void%26quot;.



It may be best for you to inform the police of a criminal act, it is possible they will send you to trading standards.

Also mention that you know your rights and would have no problem getting an atty. That alone should be enough, but I would also write a letter to the billing dept of the hospital and send them copies of the letter you sent to the bureau. Tell them they%26#039;ve got 30 days to respond or you will get an atty. Keep records of your correspondence with them. If they don%26#039;t budge you can take them to small claims, and win.

Contact the creditors and pay them. You may be able to negotiate a payment of less than the balance owed, since they%26#039;ll be happy to get even part of their money back. Most creditors will be willing to set up a payment plan, if the defaults are too much for you to pay off all at once. The problem with waiting for it to drop off your report is that the creditors could see your debt to a collection agency. The collection agency then shows up as a new creditor and the clock starts on the 7 yrs on that debt. The larger the debts, the more likely that this will happen. I%26#039;d just contact the creditors and see what you can work out. Good Luck!

If your credit card company has already reported the defaults to the credit bureaus, I am afraid there is not much you can do outside of waiting 5 more years until the negative information falls off your credit report. Otherwise, there is really no way to re-write history. Sometimes you can try to write letters to the three major credit bureaus disputing the information on the account, but if it is accurate and you really did default on the payments, they will find that out during their investigation and keep it on your credit report anyway.



Another thing you could try to do which may or may not work is call up the customer service dept. of the credit card company and try to negotiate with them. You might not get that far with them, but it%26#039;s worth a try to give them a call and see what they would be willing to have you do in exchange for having them take that info off your report. There are a lot of things that would cause you to have bad credit. I think the main things are late payments and having too many credit cards. The best thing to do is to make an extra effort to pay bills on time if it%26#039;s possible, and close some credit card accounts if you feel you have too many. Realistically we only need 1 or 2 credit cards max, they see the extra credit cards as potential debt and they factor that in to your credit score. If you have a foreclosure/bankruptcy on your credit, that can stay on there for at least 7 years, and it will be pretty much impossible to get a loan or a mortgage during that time. every month it can get better by paying up. If you have any active accounts, make sure they are never late again and save to pay off accounts in collections. stay away from credit counselors-you can do it yourself. I owed $500 to altel for breaking a contract. when i saved up $300, i called them and asked if they would settle today for a reduced amount. They settled with me for $233 because that was the cost of my bill when the phone was shut off. i have worked two and three jobs to accumulate enough cash to get out of the hole. when you do get out, NEVER get back in!!!

You can call the companies and ask them to do what I mentioned above and just keep the bills that you currently have paid up-to-date. Generally, it takes 7 years for the debts to be removed from your credit report.



Gradually, you can start building it again by opening a bank account and keeping it out of the red. You can open a credit card and occasionally put charge small amounts and pay them off- but, keep the card. I%26#039;m not sure about the mortgage.



And always visit annualcreditreport.com at least once a year and get your free copy of your credit report from each of the 3 major credit reporting agencies to keep an eye on it.

Nothing. How was the dealer supposed to know there was a problem. They probably bought it at an auction, checked to make sure it was ok and sold it. Some issues can%26#039;t be detected until they happen. That is why it is your responsibility as a consumer to take it to a mechanic to have it inspected before you sign on the dotted line. I am sure you bought the car %26quot;As is%26quot; with no warranty implied. That is exactly what you got.

You are pretty much screwed. Even in states with Lemon Laws, most only cover cars for 90 days or 3000 miles on used cars.

bypass the dealer and go right to Ford%26#039;s head office. Speak to customer service and relate your entire problem,they usually get you what you need.

Keep paying, but file your complaint with the Department of Consumer Protection. See if you can show evidence that the problems started before the 90 days were up.



In the future, don%26#039;t buy a car on payments if it is older than 5 years old. A car that old simply won%26#039;t make it 90 days without something.

we bought a 2002 f150 and about 6 mos later the clutch went out and the dealer (drive time dealership) said they would not fix the problem but the offset some payments to help us defer the cost. you might want to try to get them to do that. but a used car was some elses problem that is why they got rid of it. you assume a risk everytime you buy a used car or anything used. always think that you may have to put 1000.00 into it 6 months down the road and if you do you will know and if you dont well you got a good car that will do oyu good

Why would the dealer be responsible?



If you buy a gallon of milk and you let it go bad in the fridge after 3 weeks. Do you take it back to the grocery store and demand for it to be replaced? No.



So why would the dealership be liable for anything after the car left their lot?



I have worked in cars all my life, not sales, and it just blows me away by how many people think dealers are con artists, thieves, crooks, etc. Not even 1% are crooked and thats less then the basic retail division which is 4%.



A dealer buys a car at auction, checks it over the best he can, fixes what he see%26#039;s and then sells it. Past that he has no insight or magical ball that will tell him what will break in 2 months, 6 months or a year.



If cars were that predictable we wouldn%26#039;t need car wreckers, we wouldn%26#039;t need 1/2 the mechanics, 1/2 the dealers, etc.



Few years ago I bought a Blazer as another work truck. Bought it AS-IS. I drove around in the truck for over 6 hours testing it out, putting it through the course if you want to say. One tough sound truck. I paid, stopped by a local drive thru window for dinner and didn%26#039;t even make it another 6 miles and the fuel pump quit. After a tow and a new fuel pump...$1182 right AFTER I just paid for the vehicle.



Was it the dealers fault...no...how could it be?



Maintance and breakage is part of owning a car. When you buy a car never get what you can afford in payment but rather payment, insurance, gas and 10% of payment per month as maintanace.



So if you think you can afford $400 a month on a car, no....its $275 cause $27.50 is maintance, $50 in gas easy, $50 in insurance easy. That is the true $400 a month payment.



Since you have bad credit you have now realized that you are stuck with the buy here pay here cars, the low end cars, etc. Its the penalty for getting the bad credit. All you can do is work harder, suck it up and keep paying. The credit is the main goal to fix, not the car, just consider it cash lost to not loose as much later on.



I know the pain as I am watching cash go away due to being forced into bancruptcy a few years ago. Its the price you pay, all you can do is suck it up and keep going. To quit or fall back will just hurt worse.

It certainly is a dilemma. I would be surprised if you have anything in the way of legal recourse, although that said, I have more than once been surprised in this life.



Still, I have worked on Tauruses from time to time. I bought one from an auction once that needed quite a bit of work and fixed it up for my daughter to drive in high school. Thinking back on that experience, I was trying to imagine what the likely failures were that could amount fo so large a sum.



I recall having to replace both half shafts and all four cv joints. I also recall having to pull the engine to replace the drive plate--Ford%26#039;s flimsy stamped metal excuse for what should have been a cast iron piece of some substance.

If the car was wrecked previously, and you can prove it and prove that the dealer did not disclose this in any of the paper work you signed, then contact a lawyer. You may have a case. It depends on the state your in. However look over your paper closely. If anything you signed indicates the car was rebuilt or has salvage title you may be stuck.



The other thing to do is just to try to sell the car as is. Or trade it in for another vehicle. I hate to hear it when a sale person rips off a customer. It just makes the whole industry seem bad. Next time you purchase a used car, inform the seller you want to tkae the car to a mechanic to have it inspected prior to purchase. And take it to your own mechanic for inspection. At a minimum have a compression test done on the engine and fluids checked.

He doesn%26#039;t have all it takes. He has a serious criminal record, relating to theft and moral terpitude. No dept I know of will hire him, especially not so soon. If it was years later, he may be able to show change and a positive record since.

I agree with the other posts, continue trying to contact them..... if they say they open at 8 am, I would be calling them starting around 7:58 am so you can be first in line...... if that fails and even if it doesn%26#039;t, contact or better yet go to your bank and speak with the branch manager tell them what they are trying to do and that you didn%26#039;t authorize them to process that and see if you can get her/him to give you a statement.... or if it is possible tell them to do a stop payment on the charge.... it usually cost around $5.00 but $5.00 is better than the $149.95. Any card company that has that much of a substansial fee should be closed down in my opionion. I also suggest opening up a new account and transfer everything over to the new account..... as this may not even be a credit card company...... BUT BE SURE you contact the bank so they know you didn%26#039;t authorize the transaction and that you shouldn%26#039;t be held accountable if it does go through. If you get ahold of the company tell them that you didn%26#039;t authorize the process.. and that if they follow through with it you will be taking them to court at their expense plus more for loss time at work etc. Try to cover your bases as much as possible so you will have more of a leg to stand on if something more becomes of this.......



Also, if I may make a suggestion....... NEVER NEVER NEVER do a payday loan..... they have outrageous fees and a extremly outrageous interest rate......... I would have to see what you clicked on but it sounds like it said you were qualified, not that it actually processed you for the card. But just to be safe you need to contact your bank tomorrow or monday and make sure no such transaction took place. You might even consider closing the account and establishing a new one . If it did go through file a fraudulent charge report. Most banks will investigate and refund the amount although that can take weeks.



Edit- I read your extra details. Since you went ahead and gave out all your vital bank and personal info you must assume the worst. Contact your bank ASAP and stop it. This is fraud. If they took the money then file a report immediately. And NEVER do an online payday app. again.

I%26#039;m pretty sure that you have a certain number of days to change your mind and cancel the agreement. If so, even if they take the money from your account, they will have to refund it within a few business days.

Many car dealers will take it back and refinance your loan and give you another car. Thats how they get more money. 1.disable system restore



2.restart in safe mode and visit http://onecare.live.com and run Microsoft%26#039;s free safety scan to remove all viruses, trojans, spyware, malware, and registry errors.



3.after that restart normally and upgrade ur security protection and scan from it or download these tools below, update them and scan from them:

deleting something to the recycle bin only clears the information from that part of the hard drive an until or unless that part of the hard drive is overwritten, the information can still be retrieved from it.....you are better off reinstalling the Operating system and formatting the hard drive....when reinstalling do not setup any passwords and set the default user as %26quot;owner%26quot; or somthing like that....that way whoever gets the computer in the end can change the name and setup their own password rather than being forced to use yours. Also if it is running windows you have to supply them with the operating system disc or at least a copy of it or the restore disc that came with the computer or you cannot legally sell it with the os on it.



If you do not have the disc(s) then just format the laptop and leave it without an OS and then the person purchasing it will have to install their own copy.

ABSOLUTELY NOT! Emptying the recycle bin does not remove important information from your computer. A better way would be to re-load the operating system from your original disks. This will erase all saved information, essentially leaving the new buyer with a new computer that has no personal information in it. Although a determined hacker could go deeper into the hard drive and retrieve information....re-loading the OS (Windows XP or 98...or whatever you are running) is usually sufficient for good protection. You don%26#039;t just want to re-format the hard drive. You actually want to write data over the top of the hard disk so that there is no way that old data can be recovered.



Windows doesn%26#039;t have a built-in way of doing this. (On Mac OSX, Disk Utility has three options of erasing data, up to a 35-pass over-write and erase!)



One way you can over-write is to copy data until the hard disk is full, then delete some data, then defragment. If you do this a 3 times than format 3 times, you should be safe.



Just formatting won%26#039;t render data impossible to recover for the committed enthusiast with the right tools.

If you are selling your computer, thoroughly clean your hard drive. Deleting files and reformatting is not enough. Reformatting does not overwrite every sector, and private information can remain retrievable. Use a secure delete or disk wiping utility to overwrite every sector on all hard drives. Be sure to use a utility that supports the U.S. DoD standard of seven passes or wipes. While this method is good enough for most people, be aware that the only absolute way of destroying all traces of everything your hard drives is to have these disks degaussed (demagnetized) and physically destroyed.



Suggested: BCWipe, Evidence Eliminator, or SDelete.

hello, unfortunately i have a poor credit rating. this is to do with 3 defaults all from 2002 when I was a student (two have been settled, and one is outstanding). i really want to repair my credit rating as I am a responsible person, with some savings and will be aiming to apply for a morgage within about a year. i have heard that it is possible to actively repair credit ratings by responsibly using a high interest credit card, such as Vanquis., Acqua or Capital One. Most of your questions can be negotiated in your purchase offer such as choosing the Escrow company, Title Company, who will pay for what, contingency clauses, and when escrow will close. These items are in your purchsae contract and I suggest you have your Realtor prepare and review your purchase offer because once accepted, becomes a legally binding contract. Remember, the seller%26#039;s agent represents the seller. The agent can also represent you, but in most cases, if you will be using a buyer%26#039;s agent, his commission will be paid by the seller so why not take advantage and have yourself professionally represented and your interests protected.

Not sure what you%26#039;re asking for in having a third party submit an invoice, but if it%26#039;s to inflate and simply walk with cash, I would strongly advised a seller to counter it out. To answer your question, though, yes, you most certainly can do it that way. The only thing is that some places usually consider 4-year course work to be more %26quot;difficult%26quot; than 2-year, so you may run into that problem. I%26#039;m not exactly sure how it works with transfer credits from two different institutions, but that would be something you could address in your personal statement (i.e. point out how serious you now are regarding your grades, etc). Here%26#039;s how to do it.



1. Get your credit report.



2. See what%26#039;s on it.



2a. Is everything correct? If so, you are done, there is really nothing that you, or anyone else can do.



2b. See anything wrong? Send a letter to the credit reporting agencies disputing the claim. They will contact the creditor asking for verification. If they do not respond in a timely manner, the credit reporting agencies will remove the incorrect information.



There are companies out there that will claim to repair your credit. Scams, all of them. Even if they get a legitimate blemish off your report, the lender can just put it right back on next time they report on your status. The only reason why it looks like these %26#039;agencies%26#039; do anything is that the typical creditor does not bother answering queries from the credit reporting agencies in a timely manner. So, your blemish might disappear for a few weeks.



Want to fix your credit? Pay your bills on time every month. Even if you are only paying the minimums, pay something, on time.

You should contact a Mortgage Broker. The rules are always changing depending on the lender on how quickly you will be able to buy/refinance after a foreclosure/bankruptcy. A few years ago you could refinance immediately. 2 years ago it was at least a year. I think that it is back to immediately. But you still need to have decent credit scores. The fastest way would be for you to reestablish your credit with a couple small credit cards and maybe an auto loan. The sooner that you reestablish your credit the better.

I don%26#039;t know all there is to know about this chapter stuff but...



I highly recommend against them. They cost money that you already don%26#039;t have, all they do is forstall the inevitable. You won%26#039;t be able to get a decent mortgage when you have mortgage lates on your current record. So unless you fall into a puddle of money there is not much that chapter 13 or any other will do to help you.



What you can do to stay out of foreclosure is call some re offices and see if they or any of their investors will buy you out of your home, back fees and all. Then you avoid the foreclosure, but of course you don%26#039;t get any money and you%26#039;d still have to move.

Both are damaging to your credit. Likely the credit picture is pretty bad before either happen.



If you are in foreclosure you can file BK to slow down the foreclosure process. It does not mean you have stopped the bank from coming after the property. Just that you have put them on hold for a period of time.



There is not a lot of magic here. If you can discharge some of your bills from the Ch 13 and then could afford the mortgage then you might be OK. If you have a bunch of equity in the property you could be forced to sell or otherwise use that equity to make whole the creditors from the BK.



Credit repair is not going to remove legal actions on your credit file. They will stick for 7 to 10 years.
